Description of Service

QuickPoll.io allows you to create advanced polls in Slack channels, that all channel members can vote on. The topic and options for the poll is defined by you. Poll responses can be anonymous if specified during poll creation, and polls can be configured with various settings including hidden results, multi-voting, and time limits.

QuickPoll.io may, in the future, update current services and/or features or offer new services and/or features to the QuickPoll.io Service (including, the release of new tools and templates). Such updated or new features and/or services shall be subject to the terms and conditions of this Agreement.

Access to the QuickPoll.io Service is permitted on a temporary basis. We reserve the right to modify or discontinue offering or updating the QuickPoll.io Service at any time without notice.

Service Availability and Maintenance

While we strive to provide consistent and reliable service, we do not guarantee that our services will be available at all times. Our services may be temporarily unavailable due to:

• Scheduled maintenance
• Emergency repairs
• System upgrades
• Technical difficulties
• Circumstances beyond our control

We will make reasonable efforts to provide advance notice of scheduled maintenance, but we are not obligated to do so. We will not be liable for any losses or damages arising from service interruptions.

Intellectual Property and Content

You retain ownership of any content you create, upload, or submit to our services ("User Content"). However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content solely for the purpose of providing our services.

You represent and warrant that you have the right to grant this license and that your User Content does not infringe any third-party rights. You are solely responsible for your User Content and any consequences of posting or publishing it.

We may remove or modify any User Content that violates these Terms or our policies without notice. We do not endorse or guarantee the accuracy, completeness, or reliability of any User Content.

No Slack Association

QuickPoll.io and Slack Technologies Inc, the provider of the Slack communication service, ("Slack") are different entities. There is no relationship between QuickPoll.io and Slack, other than QuickPoll.io being a licensee and user of the Slack API for the purpose of providing the QuickPoll.io Service. Slack is not responsible for the QuickPoll.io Service and will not provide support for the QuickPoll.io Service.

These terms do not apply to your use of the Slack services. Such use is governed by the Slack Terms of Service available on the website slack.com.

User Obligations and Acceptable Use

You must be over 16 years of age to use this website and to purchase any goods or services. You must also have the power to enter into a binding contract with us and not be barred from doing so under any applicable laws.

You represent and warrant that your use of our services will be in strict accordance with these Terms. In particular, you represent and warrant that you will not use our services:

• In any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms
• To act fraudulently or maliciously, for example, by hacking into or inserting malicious code, viruses, or harmful data
• To infringe our intellectual property rights or those of any third party
• To create content that is obscene, offensive, hateful, inflammatory, or defamatory
• To promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
• To promote violence, illegal activity, or sexually explicit material
• To harass, upset, embarrass, threaten, alarm, or annoy any other person
• To mislead or deceive any person or impersonate any person or entity
• In a way that could damage, disable, overburden, impair, or compromise our systems or security
• To collect or harvest any information or data from our systems without authorization

In the event that you breach these obligations, we may terminate your access to our services immediately.

Subscription and Payment Terms

QuickPoll.io offers both free and paid subscription plans. By subscribing to a paid plan, you agree to pay all fees and charges associated with your subscription.

Payment and Billing

Subscription fees are charged in advance on a monthly or annual basis and are non-refundable except as expressly stated in these Terms. Payment will be charged to your designated payment method immediately upon subscription. You authorize us to charge your payment method for all subscription fees.

Automatic Renewal

Your subscription will automatically renew at the end of each subscription period unless you cancel prior to the renewal date. You can cancel your subscription at any time through your account settings or by contacting our support team.

Price Changes

We may change our subscription prices at any time. Any price changes will take effect at the start of the next subscription period after the change. We will notify you of any price changes at least 30 days before they take effect.

Refunds and Cancellations

We offer a 30-day money-back guarantee for first-time subscribers. If you cancel within 30 days of your initial subscription, you will receive a full refund. After this period, payments are non-refundable, but you may cancel your subscription at any time to prevent future charges.

Trial Periods

We may offer trial periods for our paid services. Trial periods are subject to these Terms and may be limited to one per user. We reserve the right to determine eligibility for trial periods.

Account Termination

You may terminate your account at any time by canceling your subscription and discontinuing use of our services. Upon termination, your access to the services will cease immediately.

Termination by QuickPoll.io

We may terminate or suspend your account and access to our services at our sole discretion, without prior notice or liability, for any reason whatsoever, including but not limited to:

• Breach of these Terms
• Violation of our Acceptable Use Policy
• Fraudulent or illegal activity
• Non-payment of fees
• Prolonged inactivity
• Request by law enforcement or other government agencies

Effect of Termination

Upon termination of your account, we may immediately revoke your access to the services and delete or remove your data from our systems. We are not obligated to retain your data after termination, though we may retain certain information as required by law or for legitimate business purposes.

Survival

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

QuickPoll.io may from time to time provide on its website, links to other websites, advertisements and information on those websites for your convenience. This does not necessarily imply sponsorship, endorsement, or approval or arrangement between QuickPoll.io and the owners of those websites. QuickPoll.io's website may contain information or advertisements provided by third parties for which QuickPoll.io accepts no responsibility whatsoever for any information or advice provided to you directly by third parties. We are making a 'recommendation' only and are not providing any advice nor do we take any responsibility for any advice received in this regard.

Copyright, Trademark and Restrictions of Use

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, trademarks and graphics. QuickPoll.io hereby grants to you a limited non-transferable right to use QuickPoll.io's logo on a royalty-free basis worldwide solely to identify QuickPoll.io as the Services provider to you. Any of us using the other's logo shall include a trademark attribution notice giving notice of the other party's ownership of its trademarks in the marketing materials in which the other party's name and logo appeared.

Limitation of Liability

It is an essential pre-condition to you using our website that you agree and accept that QuickPoll.io is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. Whole Agreement

These terms and conditions represent the whole agreement between you and QuickPoll.io concerning your use and access to QuickPoll.io's website and your use and access to the documents and information on it. No other term is to be included in this agreement except where it is required to be included by any applicable legislation. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.

Exclusion of Unenforceable Terms

Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any jurisdiction then such a clause shall not apply in that jurisdiction and shall be deemed never to have been included in these terms and conditions in that jurisdiction. Such a clause if legal and enforceable in any other jurisdiction shall continue to be fully enforceable and part of this agreement in those other jurisdictions. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.

Jurisdiction and Applicable Law

This agreement and these Terms of Service are governed by the laws of New South Wales (NSW) and Australia. QuickPoll.io is an Australian company, and any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of NSW, Australia.

However, where your personal data is processed and stored in the European Union, such processing will also be subject to the General Data Protection Regulation (GDPR) and other applicable EU data protection laws. This dual compliance ensures that you benefit from the privacy protections of both Australian and EU law.

If you are a resident of the European Union, you may also have the right to lodge a complaint with your local data protection authority regarding our processing of your personal data.
